Apple and Nokia Case Put on Hold Pending ITC Investigation

Nokia and Apple may want to go toe to toe in the legal ring right now, but they’re being told to wait a bit.
According to Macworld, the International Trade Commission has told both parties that it must complete its own probe, which was scheduled to take 45 days after it agreed to perform the investigation on February 22nd, then the lawsuit will presumably move forward. That’s if it’s still on and not settled by then, although Nokia seems determined to win it, and Apple apparently has enough bandwidth to handle two lawsuits at once.

With all of the furor around the gigantic patent lawsuit that Apple dropped on HTC this week, you might be forgiven for forgetting about the first big patent smackdown of the year, the lawsuit that Nokia laid at Apple’s door. But a judge in Delaware hasn’t — he ordered a suspension to both the case and its countersuit while the International Trade Commission works out the complaints between the two companies.
Clearly Nokia and Apple have it out for one another, but apparently they’re going to take it one step at a time. Once the ITC has completed its probe, which was scheduled to take 45 days after it agreed to perform the investigation on February 22nd, then the lawsuit will presumably move forward. That’s if it’s still on and not settled by then, although Nokia seems in it to win it, and Apple apparently has enough bandwidth (and legal fees) to pick two fights at once anyway. So bring it, ITC, and then let’s get this show on the road.

We normally wouldn’t cover something so procedural, but given the heightened interesting Apple’s patent dealings this week, we thought we’d note that Cupertino’s tiff with Nokia in the federal courts has been put on hold while both companies argue their case before the US International Trade Commission. We expected the ITC to be the primary front in this fight from the start, but now we’ll be particularly focused on the Commission’s ruling, since several of the patent claims Apple’s asserting against Nokia in this case are also being claimed against HTC. We don’t have a timeline on when the Commission will reach a decision, but we’ll keep an eye on things.

A federal judge in Delaware has signed an order halting litigation between Nokia and Apple over alleged patent infringement pending resolution of the companies’ respective claims with the U.S. International Trade Commission (ITC). The ITC announced in January that it would investigate Nokia’s claims of patent infringement against Apple, and said it would consider Apple’s claims against Nokia in February. The Associated Press reports…

Apple’s patent theft accusations against HTC got a lot of press this week, as they should! But it’s just the most recent case in a gun-slinging mobile landscape riddled with patent lawsuits. This’ll end about as well as Reservoir Dogs.
The NY Times breaks it down today with this handy chart of who’s suing whom. Nokia has been particularly active, along with Kodak. The biggest target? Apple.
Companies sue each other over intellectual property all the time, of course. But this volume of mobile technology patents is unusually high. According to the Times:
Although patent litigation is not new in the technology world, these suits, specifically around mobile, point to the drastically changing mobile landscape. Lawyers I spoke with explained that mobile technology is still in its infancy and these large computing companies are trying to stake their claim to the future of computing.
Basically, it’s a land grab. Companies that know they’re being left in the dust (Nokia, Kodak) are scrambling to assert any claims that they can, while market leaders (Apple) become fat targets.
Where does that leave the us? For now, nowhere. Business as usual. But if things keep escalating, the consequences could range from companies passing legal fees onto the consumer to ITC-imposed product bans. In these kinds of gun fights, it’s rare that anyone wins. [NY Times]
iPhone gross profit margins nearly 60%

Bernstein Research’s Toni Sacconaghi issued a 13-page report last week in which he estimated that the iPhone’s gross profit margins were an astounding 57.8%. Those margins tower above Apple’s competitors with RIM estimated to have 43% profit margins, Nokia 33%, Motorola 32%, and HTC 31.7%.
Sacconaghi believes that the iPhone’s high gross margins could change Apple’s business model as the iPhone’s share of Apple’s overall revenue stream grows from 30% in FY09 to an estimated 45% to 50% in FY11.
Philip Elmer-DeWitt over at Apple 2.0 notes that while the Street generally assumes Apple’s profit margins will decline over the next few years, Sacconaghi believes they will increase due to a few key points:
- iPhone prices are actually increasing. In Q3 2009, the average wholesale price was $588. In Q1 2010 it’s risen to $638.
- Buyers are still more than eager for the iPhone. There is no sign of price resistance from either customers or carriers. Mobile partners are still lining up to get the iPhone with Apple adding 15 new ones over the past 4 months.
Despite his Rosy outlook, Sacconaghi is reducing his iPhone shipment estimates by 1.3 million units in FQ4 10 and 5.5 million units in fiscal year 2011 under the assumption that there won’t be an iPhone for Verizon before mid 2011. He also expects T-Mobile will get the iPhone before Verizon does. As for the iPad, Sacconaghi estimates its gross profit margins to be between 30 to 32%, not the 50% suggested by iSuppli.
Sacconaghi rates AAPL as “Outperform” and has a price target of $250. In his report he states, “We believe that on a cash flow basis the stock is very attractively valued and that the stock is the most attractive secular name in our coverage universe.”

Skype App Hits Ovi Store, And Potentially 200 Million Nokia Handsets Next

Pretty huge news in our book: Skype has published a free mobile application for Symbian in the Ovi Store, basically enabling over 200 million Nokia handset users to easily download the program and start making free Skype-to-Skype calls from their phones.
If I were a carrier, I’d probably be feeling rather nervous right now – and / or infuriated.
Skype for Symbian, which you can also download the app straight from the Skype website, will run on any Nokia smartphone using Symbian^1, the latest version of the Symbian platform.
